THE ROOM Brandt & Schiewe GbR
Last updated: 24 November 2025
These Terms & Conditions apply to all contracts between THE ROOM Brandt & Schiewe GbR, Drontheimer Straße 37, 13359 Berlin (the "Studio"), and its clients ("Customer") regarding the use of the Studio's yoga and Pilates services.
Deviating customer conditions are not accepted unless expressly approved in writing by the Studio.
These T&C also apply to all future business relationships, even if not explicitly agreed again.
The Studio offers the following services: single classes (drop-in), monthly memberships, and class packs with a defined number of classes.
Registration takes place online, by email, or in person at the Studio. A contract is concluded once the Studio confirms the booking.
The Studio may decline registrations without stating reasons.
Customers must provide accurate and complete information when registering.
Prices are based on the currently valid price list published at the time of purchase.
Drop-ins: Payment takes place immediately before or after the class via the offered payment methods.
Class packs: The full amount is due at purchase. Class packs are valid for 6 months from the purchase date.
Monthly memberships: Payment is due monthly in advance on the 1st of the month via SEPA direct debit or bank transfer.
In case of payment default, the Studio may temporarily exclude the customer from participation until payment is made.
The Studio may adjust prices. Price increases for memberships will be announced at least 6 weeks in advance. Customers may then exercise a special right of termination.
Consumers have a statutory 14-day withdrawal right for online purchases under German law.
You may withdraw from the contract within fourteen days without giving reasons. The withdrawal period begins on the day the contract is concluded.
To exercise the right, notify us (THE ROOM Brandt & Schiewe GbR, Drontheimer Straße 37, 13359 Berlin, hello@theroom.berlin) via a clear declaration such as email or letter.
If you begin attending classes during the withdrawal period, the withdrawal right expires once you have expressly agreed that the service may begin before the period ends.
Drop-ins: No ongoing contract.
Class packs: Valid for 6 months; no termination required. Unused classes expire after this period.
Monthly memberships: Minimum term is 3 months. After the minimum term, the membership automatically renews monthly unless cancelled with one month's notice to the end of a month. Cancellation must be made in writing via email, letter, or in person. Extraordinary termination for important reasons remains possible.
Special termination rights apply in cases of relocation (over 50 km away), long-term illness (more than 6 weeks with medical certificate), or pregnancy. In these cases, termination may occur with two weeks' notice to the end of a month.
Participation is at the customer's own risk. Customers confirm that their physical condition allows safe participation.
Customers must inform instructors about injuries, medical conditions, or pregnancy before class.
Customers must follow instructor guidance and treat the premises with care.
Participation under the influence of alcohol or drugs is prohibited.
The Studio may exclude customers who violate participation rules.
Classes are booked through the Studio's booking system or via Urban Sports Club or ClassPass.
Drop-in and class pack bookings may be cancelled free of charge up to 24 hours before class start.
Late cancellations or no-shows result in the class being deducted in full.
For memberships, missed classes cannot be refunded, credited, or made up.
The Studio may cancel or reschedule classes due to low attendance, instructor illness, or other important reasons.
For drop-ins and class packs, cancelled classes will be refunded or recredited.
For memberships, no refund is provided, but customers may attend an alternative class.
Customers will be informed as soon as possible about changes.
Trial classes may be offered depending on availability. Conditions are communicated at registration.
A trial class does not entitle the customer to further participation without a contract.
The Studio is liable for intent and gross negligence without limitation.
For slight negligence, liability applies only for essential contractual obligations and is limited to foreseeable damages.
The Studio is not liable for damage, loss, or theft of personal items unless caused intentionally or through gross negligence.
Liability is excluded when customers disregard instructor guidance or use equipment improperly.
Liability under the German Product Liability Act remains unaffected.
The Studio processes personal data for contract fulfilment purposes in accordance with GDPR and German data protection law.
Details are provided in the Studio's Privacy Policy, which is available on the website.
The Studio's House Rules apply and are displayed on site.
Key principles include arriving on time, not using mobile phones during classes, respectful behaviour, and maintaining cleanliness in changing rooms and studio spaces.
The Studio may take photos or videos during classes or events for marketing and documentation.
Customers agree to this unless they expressly object. Objection is possible at any time.
Customers may not take photos or videos during classes unless all present individuals and the Studio give consent.
Group photos where no individual is identifiable may be used without individual consent.
Memberships and class packs are personal and non-transferable unless the Studio expressly agrees otherwise.
If any provision of these T&C becomes invalid, the remaining provisions remain unaffected. The invalid clause will be replaced by one that best reflects the economic intent of the original.
German law applies.
Where legally permissible, the place of jurisdiction is Berlin.
